
Mr. Lowe, now of counsel, has been a partner at Booth, Mitchel & Strange LLP for 33 of his 35 years with the firm, joining the firm in 1970. A trial lawyer appearing primarily for the defense, he has dealt with mediation, arbitration and trial to verdict of complex litigation matters in virtually every area of legal discipline, but emphasizes construction industry claims, particularly surety bond loss and work-out difficulties, as well as complex, primary, excess, umbrella and reinsurance matters, with an emphasis on environmental pollution, asbestos and other forms of commercial litigation. In his career, he has dealt extensively with serious injury cases, professional liability defense, including medical, legal, accounting, engineering and premises liability, and has tried in excess of 50 cases to verdict in California State and Federal Courts, as well as argued matters in most California Appellate Districts and before the Ninth Circuit Court of Appeals. He is also a member of the United States Supreme Court.
He was selected by the Los Angeles Daily Journal to be profiled in a series devoted to prominent insurance defense counsel in Southern California and has been a guest speaker and panel member on subjects related to insurance litigation and trial tactics, trial of the complex commercial case, the handling of experts in trial and discovery and other aspects of the defense of the insurance industry. In May 2002, he completed responsibilities as one of three lead trial counsel in one of ten largest cases ever tried in California, which consumed over six months of trial in three separate phases.
He received his education at the University of Utah, taking a Bachelor of Science, with an emphasis on American Constitutional History in 1967, and a J.D. at the University of Utah, where he was Chief Justice of the Moot Court, a finalist in Moot Court oral argument, winner of the best brief in Moot Court competitive argument and acted as a research assistant to I. Daniel Stewart, professor of evidence and trial practice and a member of the Utah Supreme Court (now deceased). He holds numerous academic book awards in academic classes. He is a member of the California State Bar, the Utah State Bar, the Federal Trial and Appellate Courts for the Ninth and Tenth Circuits in both California and Utah, the American Bar Association (litigation, construction and insurance law sections), the Defense Research Institute and numerous associations related to the insurance, contract surety and fidelity bond industry.
